FYI, the U.S. Supreme Court today ruled in Gross v. FBL that plaintiffs may not prevail on a "mixed-motive" claim under the Age Discrimination in Employment Act (ADEA). In other words, plaintiffs must show that age was THE factor (not just a factor) in the employment decision.
