[IPAC-List] Easterling v. State of Connecticut, Dept of Correction - Physical Ability Test

On 5/5/11, the U.S. District Court ruled (summary judgment) that the
State of Connecticut's physical ability test (PAT) for Corrections
Officer was discriminatory, in violation of Title VII. The PAT had an
adverse impact on the basis of sex and was not shown to be job-related
and consistent with business necessity. At issue was a timed 1.5 mile
run, with separate passing scores by sex and age. The overall passing
rate for women was 70.6% of the passing rate for men, and the disparity
was statistically significant. The State had no evidence of criterion
validity for the PAT, and separate passing scores by sex and age were
also improper. Interesting decision - worth reading.
