Richard,
Based on the results of the Pippen case, I assure you that my "implicit"
error does not represent an unconscious bias against either Iowa or Ohio;
and even if it does, you can't prove it.* David

* See the Bart Simpson defense - "I didn't do it; no one saw me do it; and
you can't prove it"

Yes! Sorry about that. The case is Pippen v Iowa. I am copying this email to
the IPAC List. Thanks for catching the error.

The Polk County Ohio District Court has issued its ruling in the Pippen v.
Ohio case. The Court rejected the application of implicit bias that was
relied on by the plaintiffs. the plaintiffs have indicated that they plan to
appeal, and we may see more future attempts to apply the theory of
unconscious bias. Here are links to an article today from the Desmoines
Register and a link to the text of the 56 page decision of the Court.

Since implicit bias is receiving attention in published literature it is
likely that we will see future attempts to apply this theory in employment
discrimination litigation.
