[IPAC-List] Civil service eligible lists and USERRA

I am a recovering Fire Chief, and dealt with a case similar to this. If I remember correctly, if a service member is on military leave and would have been promoted if he had not been. He gets the promotion after passing a new test. There may have been case law involved. I know our city attorney was involved in the process. I know as a firefighter, if I was the last person or only person on a list and not promoted to an available list I would file a grievance regardless of what the rules said.
