This is a very interesting discussion. We've had to address similar issues with our Personality Assessment from time to time but not with our Cognitive Ability Assessments. It is clear from your correspondence you are acknowledging there is a question about the effectiveness of the Cognitive Ability assessment you are using in the particular application you have described. In such circumstances I  don't think you have any choice but to conduct an internal validity study if you are going to continue using the assessment because you must, of course, be able to defend your use of the assessment if called upon to do so by the likes of agencies like the EEOC. I very much believe in the predictive capacity of Cognitive Ability assessments so I would suggest you collaborate with your assessment supplier to conduct that study. I fully expect such a study will address the questions you have raised while confirming the effectiveness of the assessment. 

I would very appreciate it if Harry Brull would share the "quick and easy method of reliably evaluating job performance of an incumbent group" as he offered in his email. This has been a real challenge for us over the years and is often the "weak point" in the internal validity studies we have conduct for our clients.
