[IPAC-List] Can criterion studies conducted in other countries be "transported" to the US?

Hi All -

We have a federal-contractor client that is planning on conducting criterion-related studies in other countries that comply with the requirements of the federal Uniform Guidelines on Employee Selection Procedures. They were wondering if they find sufficient levels of criterion-related validity using participants from folks outside of the United States if they could use that information to support a Uniform Guidelines 7B compliant criterion-transportability study for their facilities in the US.

In other words, can a federal contractor address the potential concerns of the EEOC/OFCCP by relying on criterion-related evidence gathered outside of the US as the basis for conducting a 7B transportability approach to validation?

Does anyone have any experience, exposure, or thoughts on this?
